Overview
Child custody refers to two distinct issues: (1) residential custody—how will the children divide their time between Mom’s home and Dad’s home? and (2) legal custody—who makes decisions for the children regarding their health, education, and general well-being?
With regard to residential custody, children can live primarily with one parent or the other, or they may divide their time equally between both parents.
Legal custody can be joint—the parents make decisions together; or sole—Mom or Dad makes the decisions.
